General
These "General Terms and Conditions" (hereinafter referred to as "GTC") which may be amended from time to time shall apply to all relations with our customers, especially also to electronic orders, distribution and handling of products by Bleu Six GmbH, Scheuchzerstrasse 71, 8006 Zurich (hereinafter referred to as "BleuSix") (hereinafter referred to as "Products") sold via BleuSix’s own webshop www.rhobie.com (hereafter referred to as "Website").
- BleuSix reserves the right to modify these GTC. In any case, the GTC in force at the time a contract is concluded, i.e. the date when BleuSix confirms the customer’s order, shall apply.
- All orders placed by you via the Website as well as our deliveries and services are governed exclusively by the GTC set out below, as applicable at the time the order is placed. We do not accept any diverging terms and conditions from the customer except where specifically agreed in writing.
- The presentation of products and the prices of Products on our Website do not constitute an offer for a purchase contract in the legal sense. If you find a product that interests you, you can click on the product name or product image to take a closer look at it without any obligations. You can put the item in your shopping basket by clicking on the button [Add to basket]. You can view the contents of the shopping basket in the window which opens immediately afterwards or by clicking on the basket icon. Products can be removed or edited by using the delete button or changing the quantity.
- As you proceed through the ordering process, you have the option of ordering via your User's account or ordering as a guest. You subsequently enter your Personal Information. In the last step, under ‘Check and order’, you can see your order information at a glance, check all the details again, and change or delete items by amending the quantity or using the delete button. It is also possible to correct input errors by going back in your browser or aborting the ordering process and starting again. To complete the purchase, you must accept the GTC.
- By submitting the completed order form provided on the Website to use the Customer placing a binding offer for a purchase contract with BleuSix. The Customer submits the binding offer by entering all required information during the ordering process and posting the order form to us by using the button "complete purchase".
- On receipt of your order, you will automatically receive an email confirming that we have received your order and listing the details (confirmation of receipt). This receipt confirmation does not mean that your offer to purchase the Product(s) has been accepted. An effective contract is only concluded when we send you another email confirming your order or a request for payment with all the contractual order details.
- A purchase contract between BleuSix and our customer will be concluded only after we have accepted the offer by dispatching the goods ordered. If payment in advance was chosen as a payment option, the goods will be dispatched only after the full amount has been credited to our account.
- We do not save the contractual information and it cannot be accessed again once the order has been completed. You can print it out in the final stage of the ordering process, before submitting your order to us. Our current terms and conditions can be viewed, saved and printed on the website www.rhobie.com
- BleuSix has the right to refuse any offer without stating a reason, especially if there are legitimate grounds to suspect that the goods purchased via the internet are intended to be resold on a commercial basis.
Cancellation and Return Policy
- You may cancel your contract of purchase within 14 days subsequent to the receipt of the Product without having to state any reasons. The fourteen-day cancellation period begins on the day on which the Products will be dispatched. To execute your right to cancel your order, you have to inform BleuSix by sending us or a letter by post or an email to [email protected] stating that you are cancelling your contract of purchase.
- The right to return only applies to unworn, unwashed and defect-free items from which the labels have not been removed. Any loss of value due to wearing, washing or causing other traces of use as well as the removal of the safety label, removal/damage of the original packaging, accessories, etc. will be rejected since BleuSix cannot offer these items for sale again. In this case, the goods shall be returned to the customer without reimbursement of the purchase price and shipment costs.
- All return shipments are made by using the same service as the original delivery (DHL) using the waybill or return label that can be requested by sending an email to [email protected]. The necessary documents and instructions for returning items will be sent via email to you.
- Please note that BleuSix only accepts returns from the country to which the original shipment was sent.
- If you cancel this contract and the Products have not yet been dispatched, we are obliged to return all payments received from you, except delivery costs (except for any additional charges resulting from you selecting a different type of delivery than the cheapest standard delivery option offered by us), immediately and within fourteen days at the latest. This period starts on the day on which we received your message cancelling this contract. This refund will be issued using the same method of payment that you selected for the original transaction. BleuSix is entitled to withhold repayment until we have received the goods. Any losses due to currency fluctuations will not be refunded.
Price Policy and VAT Handling
- All prices stated for the Products on the Website at the time of your order are applicable.
- The prices do not include costs for shipping the Products to the customer.
- For deliveries within Switzerland and EU countries, the prices on the Products include Value-added tax as applicable and respectively in each country and as well as any customs and handling charges. Shipping costs are indicated at checkout and are charged with purchasing the product.
- For deliveries outside of Switzerland and EU countries, the prices on the Website are exclusive value-added tax and exclusive of any customs and handling charges. Value-added tax and customs and handling charges shall be paid by the customer. Shipping costs are indicated at checkout and are charged together with the payment of the purchase price of the Product. Returns are free of charge, but no size exchanges are possible at this point.
Promotion Code
Exchanges or reimbursements of promotion codes, which were part of a marketing promotion or which the Customer may have received on behalf of BleuSix, are non-permissible. The disbursement of promotional codes is not permissible outside of the standard return timeframe stated according to our GTC.
- BleuSix reserves the right to cancel or block the promotion code if deemed necessary due to legal reasons, for example, in case of loss or misuse of the promotion code. You will be informed immediately by BleuSix in the case of cancelling or blocking the promotion code.
- If the Customer makes use of the legal right of return or our voluntary return policy, he will be reimbursed for the total amount of the returned items. If you are returning only one of the items from your order, the value of the promotion code will be adjusted accordingly, and only the amount relevant to the returned item will be refunded. The promotion code loses its validity proportionate to the worth of the returned item. If you are returning your complete order, the amount paid will be refunded in full, but the promotion code can no longer be applied to future purchases. Please note that promotion codes from sales campaigns cannot be replaced or refunded.
Storage of Contract Data
- The wording of the purchase is saved according to our Privacy Policy. However, it is not available to the Customer and cannot be accessed once the order has been completed. The Customer can print it out in the final stage of the ordering process, before submitting the order to BleuSix.
- BleuSix will send the Customer an order receipt by email, followed by an order confirmation email containing all the order details and the complete contractual text. You can also print out both the order and the GTC before submitting your order to us. Our current terms and conditions can be viewed, saved and printed on the website
Data Protection
- BleuSix complies with all data protection laws and will use data that could identify Customers only as set out in the Privacy Policy (Exhibit 1).
Deliveries within Switzerland and EU Countries
- The package of the Customer will be shipped with the shipping method selected by the Customer. The goods will be ready for dispatch on or after the day following the purchase price of the Product and the shipping and other handling costs are paid in full.
- The Products you ordered will be delivered to the delivery address provided by the Customer. Information on the availability of specific items is provided in the descriptions of the Product. Unless explicitly agreed otherwise, the Products in stock are dispatched within 1 to 8 working days of payment received). If a product is marked as out of stock in our shop, we will try to deliver it as quickly as possible. Other estimated delivery times are not binding unless we have agreed to a specific delivery date as an exception.
- If payment in advance was chosen as a payment option, the goods will be dispatched only after the full purchase price has been credited to our account.
- The risk of loss of the Products passes from the respective carrier to you when the delivery is handed to the Customer.
- If the Customer places an order as a business client, the risk of accidental loss and accidental deterioration of the goods and the risk of delay passes to you when the goods are handed to the haulier, carrier or another person responsible for delivering the merchandise.
Accepted Methods of Payment and Currencies
- All payments and credit notes will be handled in the following currencies: CHF, EUR, USD. Any fluctuations of currency exchange will not be covered and reimbursed by BleuSix to the customer.
- We reserve the right to reject specific methods of payment. Under no circumstances can we accept payment by cheque or cash (in any currency).
- If you choose to pay by credit card (VISA Debit, Mastercard and Mastercard Debit, American Express), you will submit your credit card details to us after placing your order. The purchase price will initially be reserved on your credit card when you place your order and we verify that you are the legitimate holder of the credit card. Then, following the completion of the sale contract, your credit card will be charged when we dispatch the merchandise.
- In transactions with consumers, the ownership of the Products transfers when the invoice amount has been paid in full. If you are a business client acting in your commercial or self-employed capacity, a legal entity under public law or a collection of public assets, we retain ownership of the merchandise until all outstanding receivables from the business relationship with the purchaser have been paid. The corresponding security interests are transferable to third parties.
General Information and Product Presentation
- For the sake of sustainable Products, we do not use chemical additives.
- The goods offered at BleuSix are presented on the Website in the form of digital photographs of the Products.
- We reserve the right to make minor changes or to alter the material, cut or workmanship of our products for the sake of improving them. Minor discrepancies between the presentation and the actual products do not qualify as a defect of the goods ordered.
- The packaging used for the Products of BleuSix is environmentally friendly. It is as small and light as possible and contains no harmful or foreign substances. Folded flat, it is easy to recycle with other paper. Alternatively, you can return the packaging to us.

Warranty
- BleuSix Products are carefully made by skilled manufacturers. The products sold by BleuSix are free from any defects – including their functionality – and free from material or production faults.
- For defects resulting from production or material errors, BleuSix shall provide the customer with a replacement of the Product free of charge. All further guarantee claims are hereby expressly excluded. The Customer’s obligation to inspect the Products and declare any defects, along with the guarantee deadline, are based on statutory regulations. Product information (descriptions, videos, images etc.) does not constitute any guarantee of certain Products. The transfer of guarantee claims is excluded.
- To exercise a guarantee claim, the Customer must fill out the complaint form with all the necessary information and submit this along with the evidence required. All claims will be assessed on a case by case basis. All BleuSix Products have a lifespan depending on the model, the materials used and the individual use of the Product. The guarantee does not extend to defects due to the wrong fit, normal wear and tear, exceeding the Product’s lifespan or damage caused by improper, incorrect or negligent use or changes to the product. Furthermore, the guarantee does not extend to defects in products not ordered from the BleuSix website.
Liability
- BleuSix shall only be liable for direct damages of the Products and only if the Customer can prove that BleuSix, its auxiliaries or third parties instructed by it have acted with gross negligence or with unlawful intent. In any event, BleuSix’s liability shall be limited to the (purchase) prices of the delivery/service in question. Further liability for damages of any kind of BleuSix, its auxiliaries or third parties instructed by BleuSix shall be excluded. In particular, the Customer shall not be entitled to claim compensation for damages not caused to the Product itself, such as loss of production, loss of use, loss of orders, loss of profits or any other indirect or consequential damage.
- Nothing in the GTC shall prejudice our liability in the event of fraudulent concealment of defects or a guarantee as to the quality, for claims based on the Product Liability Act, and for damage caused by injury to life, limb or health. This shall not entail a reversal of the burden of proof to the customer’s disadvantage.
- Any exclusion or limitation of the liability of BleuSix.com shall extend also to the personal liability of its employees, members of staff, representatives and vicarious agents.
Computer Security and Liability
- BleuSix has concluded a Computer Insurance, which shall cover any kind of damages in case of the illegitimate computer accessing or hacking by third parties.
- BleuSix is protecting its computer system with the appropriate security measures and continuously actualized firewalls to enhance its computer security and to avoid illegitimate computer accessing or hacking by third parties
- If a Customer causes illegitimate computer accessing or hacking by third parties despite the security measures and the continuously actualized firewalls on the computer system of BleuSix and the Computer Insurance rejects its liability, the Customer shall be liable, unless BleuSix has acted grossly negligent.
Miscellaneous
- The ongoing development of technology changes our services and/or the Website or the legal situation. Other reasons may as well require adjustments of the GTC regarding your Personal Information. www.rhobie.com, therefore, reserves the right to change the GTC from time to time and ask you to regularly inform yourself about its current status. Changes and clarifications will take effect upon their posting on the Website.
- If one or more of GTC is or becomes void, this shall not affect the validity of the other provisions. Where any provisions are invalid, the content of the GTC shall be deemed according to other provisions.
- These GTC are subject to Swiss Law.
- Any disputes arising about the GTC and their interpretation shall exclusively be decided by the Commercial Court of the Canton of Zurich.
